No client relationship

Reading this site, subscribing to the newsletter, joining a community or buying a product does not create an advisory, fiduciary or professional relationship of any kind between us. I do not manage money for anyone, do not accept funds, and will never ask you to send me capital to trade.

My results are mine

The daily closes and the Record describe what one trader — me — earned in specific sessions, at a specific account size, in specific market conditions. They are a record, not a projection. They are not typical, not repeatable on demand, and not an indication of what you or anyone else will earn. Independent research consistently finds that the large majority of people who attempt day trading lose money. A session or a month that worked for me may not work for me again, let alone for you.

Simulated and funded-account results

Where a result comes from a funded or evaluation account provided by a proprietary trading firm, that is stated on the post. Accounts of this kind are commonly traded in a simulated environment. Simulated results have inherent limitations: unlike a live record, they do not represent actual trading, and they may under- or over-compensate for factors such as liquidity, order queue position and slippage. No representation is made that any account will or is likely to achieve profits or losses similar to those shown. Payouts received from such firms are real money and are recorded as such; the underlying trading may still have been simulated, and both facts appear on the post.

Forward-looking statements

Any statement about what I intend to do, expect to happen, or plan to change is an opinion held at the time of writing. Markets change and so do I. Nothing here is a promise about the future.

Costs, tax and jurisdiction

Net figures are stated after commissions, exchange and regulatory fees, market data, platform costs and observed slippage. I make no claim about what buyers typically earn, because I hold no verified data on what buyers typically earn. Your outcome depends on factors outside my control, including your capital, discipline, execution, market conditions and the time you can give it.

Accuracy, errors and corrections

Figures are taken from broker, platform and bank records and checked before publication. Errors happen. If a number is wrong, tell me and it will be corrected in public: the original stays visible, the correction is dated, and the reason is stated. Nothing is quietly edited or removed, including losing sessions.

Who is responsible for your data

This site is operated by the owner of DayTraderIncome.com, operating from the State of Arizona, United States. For any privacy question, contact hello@daytraderincome.com.

What is collected

Information you give me. Your email address when you subscribe; your name if you choose to provide it; the contents of any message you send me; and, if a paid product is offered in future, the billing details required to process that purchase.

Information collected automatically. Standard server logs (IP address, browser type, referring page, timestamps) and basic analytics about which pages are visited and for how long. Email delivery systems may record whether an email was opened or a link clicked.

What is never collected. I do not ask for and do not want your brokerage credentials, account numbers, trading platform logins, Social Security number or government identification. Do not send them.

Payment information

Nothing is currently sold on this site. If that changes, payments will be handled by a third-party payment processor: card details will be submitted directly to that processor and will never be stored on this site or visible to me, and their handling of that data will be governed by their own privacy policy. This page will be updated before any product goes on sale.

How the information is used

To send you the emails you asked for; to answer your messages; to understand which content is read so I can write more of what works; to keep the site secure and functioning; and to meet legal and tax obligations.

Legal bases (visitors in the UK, EU and EEA)

Where GDPR applies, processing is based on: your consent for marketing email, which you may withdraw at any time; performance of a contract where you have purchased something; legitimate interests in operating, securing and improving the site; and legal obligation where record-keeping is required.

Who your data is shared with

Only with the service providers needed to run the site — website and email hosting, the payment processor, and analytics — and only to the extent they need it. Your personal information is not sold, rented or traded, and it is not shared for cross-context behavioural advertising. It may be disclosed where required by law, valid legal process, or to protect rights and safety.

Cookies and similar technologies

This site uses cookies necessary for it to work, including to keep you signed in if you have an account, and may use analytics cookies to count visits. You can block or delete cookies in your browser; parts of the site may stop working if you do. This site honours the Global Privacy Control signal where it is received.

How long data is kept

Subscriber records are kept for as long as you remain subscribed and for a reasonable period afterwards. Purchase and tax records are kept as long as the law requires. Server logs and analytics are kept for a limited period and then deleted or aggregated.

Your rights

Wherever you live, you may unsubscribe at any time using the link in any email, and you may ask me to show you what data I hold, correct it, or delete it. Write to hello@daytraderincome.com and I will respond within the period required by applicable law.

California residents. Under the California Consumer Privacy Act as amended by the CPRA you have the right to know what personal information is collected and how it is used, to request deletion, to request correction, to limit use of sensitive personal information, and not to be discriminated against for exercising those rights. I do not sell personal information and do not share it for cross-context behavioural advertising, so there is nothing to opt out of — but you are welcome to confirm that in writing.

UK, EU and EEA residents. You additionally have rights of access, rectification, erasure, restriction, portability and objection, and the right to complain to your national supervisory authority.

International transfers

This site is operated from the United States and its service providers may process data there. If you are outside the United States, using this site involves transferring your information to the United States, where data protection law differs from your own.

Children

This site is not directed at children and is intended for adults only. I do not knowingly collect personal information from anyone under 16. If you believe a child has provided information, contact me and it will be deleted.

Security

Reasonable technical and organisational measures are used to protect your information, including encrypted connections and reputable providers. No website can promise perfect security, and I do not.

Changes to this policy

This policy may be updated. The date at the foot of this page shows when it last changed. Material changes will be announced to subscribers by email.

Purchases and refunds

Nothing is currently sold on this site. If a paid product is offered in future, its price, delivery and refund terms will be stated clearly at the point of sale and this page will be updated before it goes live.

No warranty

This site and everything on it are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including any warranty of accuracy, merchantability, fitness for a particular purpose or non-infringement. I do not warrant that the site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, my total aggregate liability arising from or relating to the site shall not exceed the greater of the amount you paid me in the twelve months preceding the claim, or one hundred US dollars ($100). Indemnity

You agree to indemnify and hold harmless the owner of DayTraderIncome.com from any claim, loss, liability or expense, including reasonable legal fees, arising from your use of the site, your breach of these terms, or your violation of any law or third-party right.

Governing law and venue

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. You agree that any dispute arising from or relating to these terms or the site shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

Severability and entire agreement

If any provision is held unenforceable, the rest remains in force. These terms, together with any purchase terms you accepted, are the entire agreement between us regarding the site.

Changes to these terms

These terms may be updated. Continued use of the site after a change means you accept the revised terms.
